Tell Congress: Don’t let the Supreme Court "eclipse" our regulatory system

This summer, the U.S. Supreme Court will issue rulings in two cases that have important implications for regulations that protect the public and the environment.

If the doctrine known as Chevron deference is overturned, public health, safety, environmental, worker, and consumer protections will pay the price.

Chevron deference is a legal doctrine that instructs judges to defer to federal agencies when Congress has delegated regulatory authority to the agency. Without it, judges will rule on challenges to regulations based on their own personal policy preferences.

Congress should not wait for the Supreme Court to rule. It should act now to pass legislation to codify Chevron deference.
