Don’t let EPA undo fifteen years of climate progress

The U.S. Environmental Protection Agency (EPA’s) endangerment finding is the basis for fifteen years of regulatory progress on climate change through greenhouse gas (GHG) reductions.

Now the Trump administration wants to rescind the endangerment finding, along with two 2024 rules that limited GHG pollution from cars and trucks.

I am writing to respectfully request that the EPA abandon its reconsideration of the 2009 endangerment finding for GHGs. The endangerment finding is based on decades of scientific consensus and years of evidence of the devastating impacts of climate disasters on our communities.

The EPA endangerment finding was based on a Supreme Court case ruling that greenhouse gases are pollutants with a negative impact on human health and welfare that must be regulated under the Clean Air Act. The rules EPA has promulgated since then bring tens of billions of dollars in benefits every year through reduction of GHG pollution and other pollutants that are harmful to human health.
 
The reconsideration also proposes ending the 2024 GHG pollution standards for cars and trucks: the Light- & Medium-Duty Vehicle Multipollutant final rule (LMDV) and the Heavy-Duty Vehicle GHG Phase 3 final rule (HD GHG Phase 3).

EPA’s new analysis found that rescinding these rules could eliminate tens of billions of dollars in public benefits. Only by making a series of dubious assumptions could EPA make its proposal appear to make sense. I disagree with this flawed approach, which included unrealistic assumptions about gas prices decreasing, EV sales falling, and more energy demand from data centers propping up fossil fuels.

In many cases, the rule uses the bad outcomes of the Trump administration’s own policies to justify itself. This includes the assumption that ending IRA incentives will hurt the purchase of electric vehicles and the rate of installation of new wind and solar energy generation.

This is just wrong. More than 90% of energy investment nationwide in 2024 was in clean, renewable energy sources: wind, solar, and battery storage. Increased demand projections benefit the most cost-effective sources of energy first—not more expensive fossil fuels.

The science of climate change has been settled for decades. Acting now to reduce climate pollution will yield benefits for generations to come. Rules to reduce GHG pollution, including the 2024 motor vehicle rules, also provide immediate public health benefits with the reduction of dangerous air pollutants like fine particulate matter (PM2.5). Undoing these rules will take tens of billions of dollars in public benefits and worsen the climate crisis.

I ask you to end your reconsideration of the endangerment finding and leave the 2024 GHG standards for motor vehicles in place.
